Welcome to Bourbon Bro (the "App"), operated by Bourbon Bro, LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App, which allows users to manage collections of bourbon bottles and monitor their value from real-time auctions. By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
The App is intended for users who are at least 21 years old, reside in the United States, and use it for non-commercial purposes only, in compliance with applicable alcohol laws. You represent that you meet these requirements. Commercial accounts are prohibited.
You must create an account using AWS Cognito to use the App. You agree to provide accurate information and keep your credentials secure. You are responsible for all activities under your account.
You agree to use the App only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:
We reserve the right to monitor user content and take action, including termination, for violations.
You retain ownership of content you upload (e.g., profile photos or bottle photos). By uploading, you grant us a non-exclusive, royalty-free license to store, display, and use such content for App functionality (e.g., in public collections). You represent that your content does not infringe third-party rights.
We may analyze uploads for compliance (e.g., nefarious content) and remove any violating material without notice. The App is restricted to profile photo uploads and bourbon bottle photos; other photos or content are prohibited.
The App offers optional monthly subscriptions for premium features. Payments, auto-renewals, cancellations, and refunds are handled through third-party platforms (e.g., Apple App Store or Google Play) and are subject to their policies.
The App, including its design, features, and content (excluding user uploads), is owned by us and protected by copyright, trademark, and other laws. "Bourbon Bro" may be pursued as a trademark in the future. You may not copy, modify, or distribute any part without our written consent.
The App is provided "as is" without warranties. We do not guarantee accuracy of auction values or uninterrupted access. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the past 12 months.
We may suspend or terminate your account at any time for violations of these Terms or applicable laws, with or without notice. Upon termination, your access ends, and we may delete your data (subject to our Privacy Policy). You may terminate by deleting your account.
We may update these Terms. Changes will be posted here with an updated effective date. Continued use constitutes acceptance.
These Terms are governed by the laws of Minnesota, USA, without regard to conflict of laws principles.
Dispute resolution refers to how we handle any conflicts or claims arising from these Terms or your use of the App. To keep things efficient and cost-effective, any disputes will be resolved through binding arbitration in Minnesota, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. This means a neutral arbitrator (not a judge or jury) will decide the outcome, and the process is generally faster and more private than going to court. You agree to arbitrate on an individual basis only and waive any right to participate in class actions, class arbitrations, or representative actions. If arbitration is not enforceable, disputes will be resolved in the state or federal courts of Minnesota.
